'Nothing has been presented yet, but there is a possibility it will be,' says a spokesperson for the Los Angeles County D.A.'s office.

Justin Bieber may end up having his day in court if police decide to refer his case of criminal battery
to the Los Angeles County District Attorney's office for possible criminal prosecution.

Though a spokesperson for the D.A.'s office told MTV News on Tuesday (May 29) that nothing has been presented yet, that doesn't mean action isn't coming. "There is a possibility it will be," said spokesperson Shiara Davila-Morales. TMZ reported that the case will be referred for possible prosecution after Bieber was allegedly involved in an altercation with an unnamed paparazzi photographer on Sunday afternoon in the parking lot of a mall in Calabasas, California. Citing unnamed sources, the site reported that police investigating the case have already decided to refer the case to prosecutors, even though they are still in the midst of the investigation.

In addition to witnesses, the police are eager to interview Bieber, 18, who has been unavailable so far because he is on a promotional jaunt to Norway.

Los Angeles County Sheriff's Department spokesperson Lieutenant Margarito Robles told MTV News that the investigation is ongoing and that there was no update on its progress at press time. He also noted that a large percentage of these kinds of cases do get presented to the D.A.'s office, where it is left up to prosecutors to decide how, or if, to proceed.

Bieber is a suspect in a criminal battery investigation after he got into it with the photographer, who was reportedly attempting to snap a shot of Bieber when a physical altercation took place between them.

The photographer called 911 after the incident, but when the police arrived Bieber and girlfriend Selena Gomez had already left the scene. The camera man was transported to a local hospital by ambulance after complaining of pain in his upper torso and released a short time later. He filed a police report naming Bieber as the culprit and police are now investigating the incident as a misdemeanor battery case and are looking to speak to Bieber, Gomez and other witnesses. It has not yet been reported what injuries the photog allegedly suffered or what took place during the scuffle.

A spokesperson for Bieber had no comment on the incident. According to TMZ, if Bieber is charged and convicted, he could face up to six months in jail. But, given the chronic overcrowding in Los Angeles jails and a federal mandate to ease that overpopulation, it's unlikely that the singer would spend much time behind bars if convicted.

Investigators spoke to the victim in the alleged battery incident on Tuesday and would like to get Bieber's side of the story.

complaint against Justin Bieber have spoken to the alleged victim in the case and are now looking to talk to other witnesses to Sunday's altercation, including Bieber and girlfriend Selena Gomez.

A spokesperson for the Los Angeles County Sheriff's Department confirmed to MTV News that police had interviewed the unnamed victim, a paparazzi photographer who claims that Bieber struck him after he tried to take pictures of the "Boyfriend" singer and Gomez at the Commons at Calabasas Shopping Center on Sunday afternoon.

In addition to the celebrity couple, investigators are looking for any other witnesses to the incident to help piece together a narrative of what went down during the scuffle. There has been no detailed information to date on what injuries were allegedly suffered by the photographer, who complained of pain and was transported by the Los Angeles County Fire Department to a local hospital, where he was treated and released.

According to The Los Angeles Times, legal experts examining the potential case against Bieber, 18, say that the key issue is whether the pop star acted in self-defense. "These guys will often make it impossible for the celebrity to pass," said former deputy district attorney Dmitry Gorin of the obstacles paparazzi photographers often set for stars that sometimes end in physical contact. "Bieber could face a charge if he pushed or hit the photographer and it was not in self-defense," Gorin said. "But it is not really a jail-time offense."

He said the case would likely be a misdemeanor battery unwitnessed by police and the alleged victim could make a citizens arrest, at which point prosecutors would decide whether to file charges. The maximum sanction if convicted is six months in jail, but due to chronic overcrowding, his first-time offender status and the lack of police witnesses, it's highly unlikely Bieber would serve anywhere close to that term.

As of press time, the Los Angeles County District Attorney's Office had not officially taken up the case. A spokesperson for Bieber, who is out of the country promoting his upcoming Believe album, had no comment on the matter.

On Tuesday, a spokesperson for the D.A.'s office said that no case has been presented to that office yet, but that it's possible once interviews are conducted that it will be referred for possible prosecution. Wayne Coyne talks about what happens when you work with 'freaks' like Ke$ha on The Flaming Lips and Heady Fwends.
By James Montgomery

Flaming Lips mastermind Wayne Coyne took away more than just a vial of blood when he traveled to Nashville to record with Ke$ha. (Though, really, you'd think that would be enough.) He also left with his first-ever tattoo ... not to mention a newfound respect for the wild-child pop star.

"Most of the time, if someone's willing to work with me, they're going to be a freak. And Ke$ha ... I sort of thought that she would be a freak, I'd heard about her and we'd tried to get a hold of her earlier," Coyne told MTV News backstage at the Hangout Fest in Gulf Shores, Alabama. "We showed up at her house, and she has a tattoo gun that she gives everyone a tattoo with, so within 20 minutes of being at her house, I had a tattoo on my toe; it's the only tattoo I've ever had.

"We were set to do this one song that I had prepared, and we went into the studio that night, and stayed there until about 2 in the morning, and did four songs, just making stuff up," he continued. "And the next day [we] worked for another couple hours. She's funny, she's gracious, she's imaginative, she's creative and she's a lot of fun to be around."

The result of that collaboration (a song called "2012") shows up on the Lips' special Record Store Day double-LP, The Flaming Lips and Heady Fwends, a thoroughly out-there collection of songs and sound-collages that — as the title implies — the band recorded with the likes of Bon Iver, Nick Cave, Neon Indian, Yoko Ono and, uh, Coldplay's Chris Martin ... to name just a few. But will fans get to hear even more of the Flaming Lips/Ke$ha team-up? Well, Coyne certainly hopes so.

"We really loved making this music together — I think I've probably done six or seven songs with her — and I know a lot of her fans like ['2012'], but I don't know if we'll put more songs out there," he said. "She has other agendas besides doing music with Wayne, you know, but I hope so, because I think it's really great, crazy, unexpected music. And she, to her credit, loves what we do. She wants it to be whatever. She has no limits of what she wants it to be."

And don't think the Heady Fwends sessions will be the last time Coyne and Ke$ha share time (or blood) in the studio. If anything, the Lips' recent output of, uh, non-traditional releases — songs encased in gummy skulls and fetuses, 24-hour noise-jam freakouts that play for all eternity, limited-edition vinyl filled with actual blood, etc — suggests Coyne and Co. are just getting started ... and they're going to get even weirder before they're finished.

"That's been the beautiful thing about all of these weird collaborations and projects; you work with freaks. Even working with someone like Chris Martin, he's very open to, like, 'Let's do stuff!' That's the great surprise about it," Coyne said. "I don't think people are surprised when we work with a group like Lightning Bolt or Neon Indian — people think of us as like-minded — but the surprising thing with the Chris Martins or the Ke$has, they're like us too, they just don' play music that sounds like that all the time."

God Forgives, but Rick Ross does not. I wanted to make sure the ladies knew that they could be a part of this movement, a part of this project," Rick Ross told MTV News on Thursday (May 24) from the "Touch 'N You" video set in Atlanta. Sometimes after long studio sessions with Meek Mill, Wale and the rest of his MMG compadres, the Bawse just needs to get away, and that's what he aims to capture in the clip. "It's basically like a situation where life gets so hectic sometimes you just want to get away with that special female and that's what this was based off," he said.

What do you think of Rick Ross and Usher's "Touch 'N You"? There have been a lot of legends lost this year, so it's always sad to see it happen, but they are paying a couple of tributes here [at the Billboard Music Awards], and I know that they'll be classy and respectful and allow us all to remember them."

Singer/songwriter and recent "Dancing With the Stars" castmember Gavin DeGraw spoke to the group's influence with their own music, as well as the hit songs they went on to write for other artists.

"Let's talk about the Bee Gees. That's an iconic group. Not just a great band, but a great group of songwriters," DeGraw said. "Even long after the Bee Gees' success on the pop charts, they were still writing songs for other people, huge hit songs. Their talent went far beyond their moment of normal pop success. It is a loss to the music industry and a loss of an iconic group. The beauty of this industry is that we do pay tribute and every artist coming up is a fan of a generation prior to it, so there's a real tradition element to it."

Please share your condolences for Gibb's family, friends and fans in the comments.

She hasn't had the best of luck behind the wheel and it seems Amanda Bynes' streak of run-ins with the law for her driving skills is still in full swing.
According to a report put out by TMZ on Sunday (May 27), the "She's The Man" starlet allegedly ran into a car on the 101 Freeway in the San Fernando Valley back on April 10th and proceeded to flee the scene.
As described by the victim, the driver was behind the wheel of a 5 series BMW in which they managed to get the license plate number and a profile view of the driver before heading off on a small chase. The victim said they followed the culprit off of the freeway, but could not keep up when the other driver blew through a red light.
Once the California Highway Patrol showed up and ran the license plate number, they informed the victim that the vehicle was rented from Enterprise. Following the meeting with CHP, the victim took the next step by calling Enterprise and was then told that the person whom the car was rented to was none other than Miss Bynes.
The victim then took the information to the CHP substation where they ended up identifying the actress from a photo lineup that included Amanda's previous DUI mugshot from a few days prior.
Law officials say the case was referred to a filing officer at the L.A. City Attorney's Office, but the case was immediately rejected due to insufficient witness accounts proving Amanda as the driver.
As previously reported by GossipCenter, the 26 year-old was already cited for a DUI after hitting a cop car and was later nabbed for another hit and run earlier this month in Hollywood.

Seoul, South Korea, set list heavy on new material, but Gaga's biggest hits come out to play.
By John Mitchell

Lady Gaga kicked off her hotly awaited Born This Way Ball at Seoul, South Korea's Olympic Stadium on Friday (April 27) in front of 45,000 fans, and despite protests from Christian groups saying Mother Monster was "obscene" and could "taint" young people with her performance, the concert appears to have gone on without incident.

Intrepid Twitter fans are already showing off pictures and video of the BTW Ball's enormous Gothic castle backdrop and myriad costume changes, making it clear that Gaga has outdone even her own Monster Ball in terms of spectacle.

While we wait for reviews to trickle in from halfway around the world, one thing is certain: No minors were corrupted at the show. Earlier this month, the Korea Media Rating Board decided to elevate the age rating for the concert from 12 to 18, prohibiting minors from seeing the concert. When the board notified Gaga's tour promotion company and a sponsor of the change in age restrictions, it did not offer a reason why the show — which at the time was still in rehearsals and had not been reviewed publicly — was considered unsuitable for children under 18.

The likely catalyst for the board's decision came more into focus as the concert neared and protests from a group of conservative Christians calling itself the Alliance for Sound Culture in Sexuality ramped up. The group covered Seoul with posters accusing Gaga of "spreading unhealthy sexual culture" through "lewd lyrics and performances."

The superstar and her fans, however, were undeterred. Though she tweeted her hopes that the Korea Media Rating Board would reverse its decision (it didn't), she continued on as planned. Many fans reportedly arrived at the show wearing versions of Gaga's most well-known flamboyant costumes, and there have been no reports of disturbances at the concert.

Before the show, Gaga tweeted, "I can you hear you Korea. I'm shaking."

Gaga's performance was heavy on material from her Born this Way album, though her biggest hits, including "Bad Romance," Poker Face" and "Just Dance," were represented.

Lady Gaga's Born This Way Ball set list:

» "Highway Unicorn"
» "Government Hooker"
» "Born This Way"
» "Bloody Mary"
» "Bad Romance"
» "Fashion of His Love"
» "The Queen"
» "Just Dance"
» "Love Game"
» "Telephone"
» "Just Dance"
» "Heavy Metal Lover"
» "Bad Kids"
» "Hair"
» "Yoü and I"
» "Electric Chapel"
» "Americano"
» "Poker Face"
» "Scheiße"
» "The Edge of Glory"
» "Marry the Night"

Did you see Lady Gaga's Born This Way Ball?
